Website Design Project Terms and Conditions
1. Project Scope:
- The scope of the website design project is defined in the project proposal and any subsequent discussions. Any additional features or changes requested by the client that are not within the initial scope will be subject to additional charges.
2. Payment Terms:
- A non-refundable deposit of [percentage]% of the total project cost is due before work begins. The remaining balance is to be paid according to the agreed-upon milestone schedule. Failure to make payments may result in project delays or termination.
3. Project Timelines:
- The project timeline will be outlined in the project proposal. Delays caused by the client, including but not limited to late feedback, content provision, or approvals, may extend the project timeline. Timely responses from the client are essential for the project’s success.
4. Client Responsibilities:
- The client agrees to provide all necessary materials, content, and feedback in a timely manner. Failure to do so may result in project delays. The client is responsible for ensuring that all provided materials do not infringe on any third-party copyrights.
5. Revisions:
- The project includes [number of] rounds of revisions. Additional revisions beyond this limit may incur additional charges. Major scope changes or design changes after the approval of the final design may also result in additional fees.
6. Intellectual Property:
- Upon full payment, the client will own the intellectual property rights to the final design. Until full payment is received, the designer retains ownership of the design. The designer may showcase the project in their portfolio unless the client explicitly requests otherwise.
7. Termination:
- Either party may terminate the project with written notice if the other party breaches any material obligation. In the event of termination, the client will be invoiced for work completed up to the termination date.
8. Confidentiality:
- Both parties agree to keep confidential all information exchanged during the project. The designer may reference the project in a general sense for promotional purposes unless the client requests confidentiality.
9. Hosting and Maintenance:
- Unless otherwise agreed upon, the client is responsible for website hosting and maintenance after the project is completed. The designer may provide ongoing support at an additional cost.
10. Legal Compliance:
- The client is responsible for ensuring that the website complies with all applicable laws and regulations. The designer is not liable for any legal issues arising from the content or functionality of the website.
11. Dispute Resolution:
- Any disputes arising from this agreement will be resolved through negotiation and, if necessary, mediation. If resolution is not achieved, the matter may be taken to a court of competent jurisdiction.
By proceeding with the project, both parties agree to the above terms and conditions.
